O presente artigo cientifico visa estudar as origens do Tribunal do Júri, quais suas regras e seus princípios, hipótese de cabimento, quais seus problemas e quais as possíveis reformas que poderiam ser aplicadas a esse órgão do Poder Judiciário. Em suma, trata-se de um estudo que tem como objetivo analisar se tal órgão ainda é necessário ou se já perdeu sua relevância em virtude das mudanças pelas quais a sociedade passou ao longo do tempo. Procurou-se analisar as diversas críticas apontadas a esse instituto, sendo que para tal análise foram feitas pesquisas bibliográficas, e buscou-se na doutrina correntes de apoio e rejeição. Uma pergunta essencial foi feita para que este trabalho pudesse ser realizado: o Tribunal do Júri tornou-se anacrônico ou ainda é uma garantia constitucional do réu? Encontrar argumentos sólidos para responder a essa questão foi o objetivo central do presente trabalho, sendo, por isso, necessário estudar sua história, princípios, pontos positivos e negativos.

The aim of this study was to develop an analytical model of full stochastic programming, grounded on the Real Options Theory (ROT) for the analysis of the value of the investment opportunity in project to implement Enterprise Resource Planning (ERP) system. The proposed model is a modified extension of Wu et al. (2008), incorporating the possibility of a catastrophic event (or contingent event), as discussed in Schwartz and Zozaya-Gorostiza (2003). While a programming and stochastic optimization model, it is inserted in the context of Operational Research, whose nature, as the name implies, is the use of analytical scientific method to address operational problems in organizations. The managerial flexibility of the model was treated as a real option, in which there is the right, but not the obligation, to perform an action (for instance, postpone, expand, contract or abandon. The strategic decision concerned the possibility of purchasing and implementing the system as a whole package or through modules. Revenue estimates for the project were modeled as a stochastic process of the Geometric Brownian Motion type, while costs were modeled as a function of the characteristics of each cash outflow type, resulting in the choice of a probability distribution. The model uses Latin hypercube simulation to obtain the expected values of the parameters for generating a decision tree that guides the optimization process. Given the parameters and constraints of the model, the optimization searches for the optimal investment decision. Considering the model configuration and parameters adopted, the figures indicate that the process of purchasing and implementing the modules result in an optimal decision for the value of the investment opportunity. Furthermore, the sensitivity analysis of the parameters allowed the identification of the most sensitive parameters in the model that need careful analysis, to avoid distortions in the projections.

O desenvolvimento e crescimento urbano social da cidade de São Paulo percorre um longo percurso pela história. Este, por sua vez, é marcado por inúmeras e variadas intervenções realizadas pelo homem sobre o seu sítio urbano, caracterizando, assim, um cenário complexo e problemático, que tem como uma das principais adversidades a formação informal do que aqui se refere por barreiras urbanas. Para compreensão deste essencial conceito, serão abordados diferentes significados do mesmo, associados à discussão histórica de como barreiras físicas e sociais se estabeleceram na estruturação urbana de São Paulo, tendo como foco o quadrante sudoeste da metrópole. A partir disso, busca-se analisar um recorte urbano caracterizado pela existência de um conjunto de tais barreiras, criadas e estabelecidas pela intervenção e construção do homem no tecido urbano da cidade. O trecho entre a Favela do Jardim Panorama e a Avenida Luís Carlos Berrini, se apresenta, portanto, como um desses contextos metropolitanos, que traz junto com isso grandes potenciais naturais, sociais e urbanos. Discutir-se-á, pois, quais são essas variadas condicionantes e as intervenções diretas que este território sofreu até a consolidação de seu estado complexo e problemático atual.

The main objective of this study was to investigate the perception and contribution of the managers of Controller s Department to sustainability in a retail, fashion and consumer electronics industry. The research fits into the business environment in which sustainability is increasingly present in the strategic agenda of corporate executives due to greater stakeholder engagement regarding socially responsible organizations attitude as a theme. In this intent, we posed the following research question: how is the adoption of sustainability based on the triple bottom line model influencing the practices of the Controller s Department of the company? Thus, for conducting this research, it has been assumed that the economic view is the prevailing one in the functions of the Controller s Department and managers are still unclear about the contribution of the management in the social and environmental aspects. Therefore, to achieve the research objectives, we proceeded with analysis of the literature on the topic of sustainability and Controllership. The typology of this research is exploratory with qualitative approach because it aimed to investigate how sustainability is influencing the Controller s Department and the contribution of managers by adopting the theme. The method used was case study. The sample was selected by the criterion of accessibility and processing of data was done through content analysis. The research findings indicate that sustainability issue still needs further understanding of the managers of Controller s Department in their conceptual, procedural and organizational aspects; which is the economic view that prevails in the functions and activities of managers.

One of the most important components of the economy is the price of foreign currency, in this case the dollar. The control of volatility and price level, essential to avoid economic turbulence, almost obliges the monetary authority to intervene in the foreign exchange market. The foreign exchange swap, a widely used derivative in Brazil, is an instrument that allows sterilized interventions, with no impact on liquidity. The study identified, on the basis of high frequency data analysis of the future dollar market, the impact that the Exchange Swap auctions provoke on business volatility in the future foreign exchange market, the difference of reaction to the scheduled auctions and surprise, to rollovers or offers of new maturities. Numerous studies are inconclusive, given the method, period and / or applied tests. The ARCH-GARCH models were used to identify the level of volatility in each adjacent period to each auction. The quantification of periods with the increase volatility indicates that the interventions of Central Bank through Currency Swaps have little effectiveness in reducing the volatility in the trades made in the future foreign exchange market, standard contracts - DOL and mini-contracts - WDO, especially during ten minutes of the auction. On the other hand, the auctions to offer new maturities, scheduled or not, increase the volatility in a significant number of trading sessions, especially in the ten minutes after the auction.

Identifies the bibliographical publications in journals on joint attention, which is characterized by the ability of triadic coordination of attention between the self, the other, and a third event, object or symbol. The results are related to the review of literature on the subject, concerning the investigation about the influence of joint attention on autism. Thus, studies published and indexed in the data bases MEDLINE, LILACS and SCIELO were previously identified. It highlights joint attention as a possible predictor of risk of children autism, and concludes that its development tends to occur in the first year of life. Joint attention represents an important type of communication, besides being a possible way for children to learn about things in their environment.

This paper aims to demonstrate the conceptual premises and proposition of a dashboard applied to the Budget and Finance subarea of the São Paulo Defense School - EDEPE. Thus, the aim will be to demonstrate that tools for management and budget control are fundamental for decision making in organizations and is also an instrument for transparency of budget execution, as well as planning and financial controls in public agencies with small own funds. The methodology adopted was Design Science, since it aims to contribute to the design and development of a technological and innovation tool. The choice of dashboard format is due to the ease of understanding and visualization of information and budgetary and financial data to be used in decision making, especially by managers, who in this case are legally trained. Through the development of a new and unique database, searches are optimized and information is presented through easy-to-understand, informative and interactive graphics, which is an efficient solution that solves the difficulties initially encountered and can solve problems. similar in other public organizations.

In the triple border of Brazil, Paraguay and Argentina, trafficking in women is recurrent. The present study focuses on the International Trafficking of Women for the Purposes of Sexual Exploitation in the region of the Brazilian triple border. Border countries are signatories to the Additional Protocol to the United Nations Convention against Transnational Organized Crime for the Prevention, Suppression and Punishment of Trafficking in Persons, Especially Women and Children. Both states seek through internal laws and public policies to implement the Palermo Protocol, but the measures used prove to be inefficient to prevent crime, in front of a border that has a failed inspection. The research will indicate the laws and actions of each country to combat the International Trafficking of Women for sexual exploitation and its reflexes in the region of the cities of Foz do Iguaçu, Puerto Iguazú and Ciudad del Est.

A presente monografia visa analisar a efetivação do direito concorrencial no Brasil e nos Estados Unidos, utilizando o caso U.S., et al. v. Ticketmaster Entertainment, INC. et al. para melhor entendimento das práticas americanas, e traçando breve paralelo entre as possíveis similaridades entre os sistemas. Para tanto, inicialmente traçou-se um panorama geral a respeito do direito concorrencial, incluindo seu desenvolvimento histórico, fundamentos e conceitos, sendo seguido por uma abordagem sobre a indústria do entretenimento de música ao vivo e todas as particularidades deste mercado. Em um segundo momento, analisou-se especificamente o caso já citado e o tratamento prático dado ao ato de concentração econômica perante a legislação norte-americana. Ao final, é delineado o tratamento dado a tais atos pela legislação brasileira, bem como traçado breve panorama entre os principais aspectos de ambos sistemas normativos. Para a efetivação do presente trabalho, realizou-se pesquisa qualitativa, de caráter bibliográfico – com base na doutrina existente sobre o assunto – e documental – diante dos normativos e relatórios públicos, nacionais e norte-americanos, que tratam do tema –, bem como trouxe estudo de importante caso no âmbito americano. Ao final, depreendeu-se a real necessidade de atuação dos órgãos controladores do mercado econômico, para que o direito concorrencial se efetive nas relações práticas, não apenas na análise das operações e na imposição de medidas mitigadoras aos atos anticoncorrenciais mas, também, durante a vigência do acordo firmado, para a adequação das medidas à mutável realidade econômica.

This work is a research of TIM Música nas Escolas developed with students of periphery of Sao Paulo. After selected 120 childrens of 5 thousand that participated of music workshops, was divided in 4 groups of 30 students, what I had the opportunity to teach music during the period of 2003 through 2005 to a class of EMEF General De Gaulle located at Jardim Sao Luis, south of the city. In the begining of 2006 the class was tranfered to an auditorium of Ibirapuera School and guided to a deeper study of singing and musical instruments with a goal to build a symphonic band. A research of this work with the students of this project was done with the results until the end of 2008. This research had the ambition to help on the studies of social projects with kids that is in a risc situation and that uses the music as an instrument to a social inclusion.

The present work was carried out with the objective of reviewing the business model of a Brazilian company in the furniture industry and proposing strategies for its development, through an increase in the supply of value and sources of revenue. Potential effects involve expanding market share, regaining market leadership, developing value for the company brand, and establishing various channels of relationship with the consumer market. The diagnosis resulted in the proposition of a new business model, based on a new mission statement, in which the value offer is based on the convenience offered to the clients, according to the market with philosophy, which represents an innovation that inspires the process decision to differentiate it from competitors. From the strategies proposed and adopted, the planning of the actions to be carried out was carried out, indicating the resources involved, deadlines for execution and those responsible. Some of the proposed actions have already been implemented and others continue to be implemented. The main contribution will be reflected in the gain in market share and management quality of the company, with greater efficiency and effectiveness and value creation potential. This is a proposal applicable to a specific organization that tends to develop its conditions for value creation. In addition to the direct health and prosperity benefits of the company, the proposed actions tend to influence the development of management technology and can be replicated in similar situations experienced by other companies.

O presente artigo objetiva realizar um estudo de casos que envolveram discussões acerca da relação de consumo no que tange a publicidade enganosa e a sua aplicação ou não nos julgamentos dos casos selecionados que tiveram grande repercussão, conhecidos como “Uniesp Paga”. A publicidade engloba várias formas de persuadir o espectador-consumidor. Com a vasta concorrência experimentada no comércio em geral, a publicidade tornou-se um diferencial no tocante a atrair a atenção do consumidor ao que se pretende vender. Já a publicidade enganosa induz o consumidor a adquirir algo que iludido por falsas promessas, não o adquiriria se o fossem repassadas corretamente as informações acerca da “coisa” anunciada. Analisou-se onze processos de diferentes Comarcas e Varas do Estado de São Paulo e o que foi verificado aponta que a maioria dos julgadores entenderam não haver o dano narrado pelos estudantes no caso “Uniesp Paga”.

This dissertation intended to utter cultural and discursive impressions in two North American film advertisements disclosed for the Portuguese and Brazilian audience in movie theaters and video rental shops. The theoretical background was based on the theory of Discourse Analysis (French-oriented) and Culture, as well as respective identity formations, as a manner of expression of ideas, feelings, behaviors, ideologies and sense effects. It was followed by a brief history on how the English, Portuguese and Brazilian languages were formed in order to understand cultural differences encountered in language and by a presentation of matters arising out of advertisements, comprised of title and image, whose cultural production is meant for the film audience. In consultation to the cinema history, advertisements of Miss Congeniality (2000) and It s a Wonderful Life (1946) were selected, evidencing that the disclosure of North American ideology a is not a feature pertaining to a certain decade and that the title thereof is not inclined to be literal as time passes by as it was expected by the massive influence of the English language as a worldwide language. Upon the analysis of these impressions, it was observed the difference of use within the same language - the Portuguese - as a manner of expressing the North American culture against Portuguese and Brazilian cultures.

Era este o cenário de Santa Cecília desde meados da década de 1970 até recentemente. Basta uma pesquisa breve na internet para notar que algo novo vem acontecendo com este tradicional bairro de São Paulo. Chamadas de reportagens como “Jovens mudam a cara da Santa Cecília”1 são comuns desde o começo da última década. Todas as matérias têm em comum uma mesma argumentação: o bairro está passando por uma retomada no mercado imobiliário. Existe hoje, ainda, uma confusão do que se define por Santa Cecília. A transição entre Higienópolis, Vila Buarque, Consolação e Campos Elíseos, Santa Ifigênia e República nunca foi bem definida. Há alguns ainda que vão além e confundem com Perdizes e Pacaembu. No curta metragem “O que foi, o que é e o que será Santa Cecília”2, José Marques Araújo, então diretor da Secretaria Municipal de Planejamento, afirma que essa confusão se dá a uma não delimitação formal dos perímetros por parte do poder público. Por critérios metodológicos definiremos como Santa Cecília o polígono formado entre as ruas Jaguaribe, Dr. Veiga Filho, Rua Tupi, Avenida General Olímpio da Silveira, Rua Amaral Gurgel, Av. São João e a rua Dr. Frederico Steidel. Esse perímetro foi definido a partir de análises de mapas históricos nos quais é possível observar a consolidação dessa porção da cidade: a abertura de ruas em chácaras próximas entre si num período próximo de tempo, sob uma mesma lógica. Assim, aquilo que não é nem Higienópolis, nem Vila Buarque, tampouco República, Campos Elíseos ou Pacaembu, pode ser considerado Santa Cecília
