The Constitutional Amendment n.º 19/1998, as an instrument to ensure the effectiveness of the State Reform, titles its justification red tape decrease and efficiency improvement by Public Administration, altering the text of article 173, 1st paragraph of the Brazilian Federal Constitution, which then determined that the legislation will stablish the Articles of the public company, private and public company and their subsidiaries with economic activities, that shall also state the regime for bids and contracts. After 18 years of legislative inertia, among the political crisis experienced in Brazil and popular pressure that demanded better moral standards from Public Administration, the Federal Law nº 13.303/2016 was enacted, describing the legal regime applicable to all stateowned companies, for those which develop economic activities and also for the ones that render public services, including the legal regime regarding bids and contracts. Therefore, under this matter, a question arose concerning the accordance of the legal provision and the constitutional commandment. For that reason, this masters dissertation objectives to answer this question, through doctrinaire and legal precedents research, as well as classic interpretation methods, swayed by the application of constitutional interpretation principles.

The different methods of obtaining two-dimensional materials are being researched intensively, due to their promising physical and chemical properties. Among the methods of obtaining graphene, the liquid phase exfoliation (LPE) of graphite is proving to be a relatively simple and efficient process for the production of flakes of high quality and large scale. It is primarily based on the separation of the layers of graphite in liquids, such as common organic solvents and aqueous surfactant solutions. In this work the exfoliation of graphite was performed in liquid phase by sonication in aqueous suspension in the presence of an industrial reagent. A comparison with suspensions not using the polymeric surfactant indicates that its presence is necessary, because it prevents the re-agglomeration of the layers after sonication, through the multipolar and electrostatic repulsion mechanism. This result coincides with the reports of most recent works on liquid-phase exfoliation of graphite.

When the king had issues to deal with or wanted to hear the opinion of the most important men regarding any certain subject, he would gather lords and the most important members of the clergy for a meeting. In Portugal and in the kingdoms of Spain, these meetings were named Courts . In France, they were called General States . And in England, they were called Parliament . Each Parliament evolved and went through several stages until we got to the models of the 21st century. Several functions were attributed to the Parliaments, such as, for instance, to legislate and control the Executive Branch. However, amongst all its attributions, the representative function is fundamental, because it turns the Parliament into an institution that is essential for democracy. Representing the people s will is not easy, and choosing the representatives is not something simple to be done as well. Being a ruler or ruled brings about rights and duties for both sides. Should the congressman comply with the voter s will, his political party or his own beliefs? This study looks for answers for these questions by means of the analysis of the political representation in a democratic environment. More specifically, it examines Brazil and its Federal Parliament. The study of the complex relationship ruler-ruled and of the representative function of the Parliament contributes to point out possible paths and alternatives for the improvement of the Brazilian representative system.

The city of Monte Sião is known nationally as “The National Capital of Knitting”, the knitting production in the region is an old practice and inherent to regional culture, left as an inheritance by the Italians who populated it. In detriment of this sociocultural value, this dissertation intends to analyze the socioeconomic impacts arising from the consolidation of the municipality of Monte Sião/MG as an industrial pole in the production of Brazilian straight mesh. From a hypothetical-deductive approach in line with a case study, it proposes to verify the possibility of recognizing the city of Monte Sião as a geographical indication in knitting production in Brazil.

O presente trabalho apresenta um estudo sobre o território na área do Brás, mais precisamente no entorno da estação intermodal. Os aspectos relacionados aos espaços residuais e a relação entre infra-estrutura urbana e cidade são tidos como prioritários para pensar novas intervenções. Desta forma, o estudo busca analisar alternativas de requalificação e reintegração destes espaços, priorizando a escala local e propondo novas alternativas de conexões para o tecido urbano. A ocupação de vazios urbanos, foi colocada como consequência da análise das dinâmicas sociais já existentes na área. As reflexões sobre a possibilidade de novos usos ao espaço urbano, apontam o caráter multicultural do bairro. A compreensão das novas demandas dos imigrantes e refugiados, torna-se essencial para promover a integração desta parcela da população e contribuir para que tenham seus direitos assegurados. Sendo assim, a presente pesquisa coloca a proposição de uma nova travessia urbana. O projeto do edifício ponte sobre a linha férrea foi concebido visando atender as necessidades dos imigrantes e promover a interação cultural.

This work shows that the allegorical hermeneutics underwent a paradigm shift in philosophical postmodern, and it brought influences in the development of faith and their setting. Since the history of interpretation as a thread through the literature search is described as allegorical hermeneutics evolved and remained relevant. The philosophical paradigm shift that led to the emergence of postmodern discourse is explained and demonstrated through dialogue of literature. In order to substantiate this hypothesis, based on studies, speeches, and publications of notably neo- Pentecostal churches reveals their use of allegorical hermeneutics from a worldview grounded in postmodern postulates with existential worldviews. It is concluded that the application of the primal allegorical hermeneutics, that shaped the discourse of Christianity, sometimes single, sometimes shared, but always referenced the existence of a fact, gave rise to a fluid hermeneutics, blurred the text to the reader-listener, generating a new way of experiencing the sermon in society, and the changing relationship with the world.

The thesis proposes an analysis of the punitive civil and administrative anticorruption system, created by Law n.º 12.846/13, for the treatment of illicit conducts generated by the behavior of the legal entity and its agents, which affect the national public patrimony and foreigners, the principles of public administration and the international commitments assumed, according to art. 5, "caput", of said law. The identification was made because the administrative and civil interference of such sanctions directly affect the free competition proposed by the Market Theory and the Federal Constitution. Therefore, the comparison between the penalties imposed on legal entities and the result obtained for the market and for competition, even with mitigating measures, is fundamental for clarifying the legal panorama incident on the system of corruption in the activities of legal entities. Thus, with the study of this affectation, it will be possible to identify whether the anti-corruption mechanisms in the civil and administrative sphere will strengthen free market competition or, depending on the institute and the way of application, could destabilize the market, competition.

O presente trabalho destina-se a analisar, com suporte em pesquisa empírica, tanto no âmbito da estrutura administrativa legal, quanto no orçamento municipal, as dimensões da governança e do desenvolvimento turístico dentro dos municípios estâncias paulistas. O Estado de São Paulo criou regras de governança municipal através da Lei Complementar n. 1.261/15 e do fundo para desenvolvimento destes municípios, instrumentalizado pela Lei n. 16.283/16, havendo dotações orçamentárias voluntárias do governo estadual para investimento em infraestrutura turística. Objetiva-se comparar os municípios estância de Campos do Jordão, Mongaguá e Olímpia em confronto com os municípios de Capivari, Monte Mor e Porto Feliz, a fim de ver as semelhanças e diferença entre eles nos seguintes critérios: estrutura administrativa legal e orçamento anual aplicado. O estudo baseia-se nos dados coletados do período de 2008-2018 com a finalidade de minimizar os efeitos sazonais políticos-governamentais. Espera-se contribuir com um panorama comparativo que demonstre quais os impactos de configuração de um Município como estância turística no tocante ao seu orçamento, bem como à sua estruturação administrativa, para então contribuir para o debate da governança turística e seus reflexos financeiros e administrativo-organizacionais, do ponto de vista do desenvolvimento local e da sustentabilidade. Trata-se, portanto, de pesquisa que envolve questões de políticaspúblicas, modelos de gestão e de desenvolvimento.

The Theory of Financial Decision Making tries to understand and explain how individuals and their agents make choices among alternatives that have uncertain payoffs over multiple time periods. The theory that explains how and why these decisions are made allows serveral models, presented in this thesis. However, the ortodox theory does not recognize the qualitative importance and quantitative implications of the interactions among irriversibility, uncertainty, and optimal point in time for investment. Decision making involves almost always three important characteristics; the investment is partially or completely irreversible, there is uncertainty about the stream of future cash flows, and there is a window of time for the decision to be made. These characteristics have to be taken into consideration in determining the optimal time for investment, because flexibility has value. The objective of this thesis is to demonstrate that the real options approach to uncertainty in resource allocation and investment decision making is able to capture the value of managerial flexibility properly and produces better results in modeling the optimal time to cut a stand of trees in a forestry investment project. The theory of real options is used to model the optimal tree harvesting decision. The linear complementarity partial differential inequalities were solved using the numerical method known as fully implicit finite difference method, with the projected over relaxation (PSOR) algorithm, using a software developed specially for this purpose.
