A articulação do ônus probatório nas ações de improbidade administrativa
A presente pesquisa tem por foco o estudo crítico-científico da articulação do instituto do ônus da prova nas ações de improbidade administrativa no ordenamento jurídico brasileiro, que são atualmente disciplinadas de modo específico pela Lei nº 8.429/1992. Primeiramente, são feitas considerações sobre os aspectos gerais da improbidade administrativa, oportunidade em que se ocupa brevemente da análise dos princípios constitucionais da Administração Pública, conceituação do instituto, histórico de fontes normativas, espécies de atos de improbidade administrativa e suas respectivas sanções, bem como todos os elementos constitutivos do ato de improbidade administrativa. Na sequência, abordam-se os mais relevantes aspectos processuais da ação judicial que tem por objeto a prática do ato de improbidade, dentre os quais a natureza desta espécie de demanda judicial, legitimidade para sua propositura, competência para processamento e julgamento, possíveis medidas cautelares que nela podem ser concedidas e prazos prescricionais a ela aplicáveis. Sucessivamente, ainda tratando de questões de ordem processual, parte-se para uma sucinta análise do ônus probatório no direito brasileiro, ocasião em que se aproveita para delimitar o conceito do instituto e demonstrar as regras de sua aplicação prática no processo civil, penal e administrativo. Por fim, após analisar as principais circunstâncias que envolvem a Lei de Improbidade Administrativa e a Teoria Geral da Prova, cuida-se especificamente da articulação do ônus probatório e da possibilidade de sua inversão nas ações de improbidade administrativa, momento em que também se analisam alguns emblemáticos julgados do Superior Tribunal de Justiça e do Tribunal de Justiça do Estado de São Paulo acerca da temática.

O edifício e a lei em São José dos Campos
This thesis has on its objet the verticalization process in São José dos Campos and it is correlation with the urban legislation. It can be seen that the urban legislation in Sao José dos Campos and others brazilians cities is a fundamental factor in the verticalization process. This study has the emphasis on the buildings relationship with the city planning legislation, the ratio with urban social space production and the socio-spatial segregation. It is believed that the city planning legislation not only serves the capital interests, but it is also a key to understanding the urban thought at the time it was applied and, especially, to identify its different political and economic contexts. We seek to understand the role of the real estate market and its relation with the city planning legislation and the buildings and its urban insertion and the effects of vertical integration in the urban fabric and the city landscape. In São José dos Campos, as well as in most brazilians cities, the Government have encouraged the verticalization process, largely through planning legislation such as Building Codes, Master Plans and mainly by the Laws of Use and Occupation Soil (Zoning). This study aims to contribute to the development of new urban policies focused on improving the life quality for the city dwellers.

Pulp fiction: diálogos com outras mídias
This dissertation minds the formal aspects of the film Pulp Fiction (1994), by Quentin Tarantino, under a perspective of intermediality. Henceforth, it aims to assess the extent in which the director’s style fall back on signs and meaning settlements inherent to the language of other means of communication, such as the television, the comic books, video games and the past of the cinema itself. In these terms, the research divides itself into three main segments: the examination of the film narrative procedures (that concerns temporal ellipsis, flashbacks and a round structure intricate by three parallel stories); followed up by the discussion regarding the ostensive violence on the screen (which comprehends to the graphic violence stylization grounded on the saturation of visual signs and on the hybridization of different medias) and the analysis of dialogue constitution (which are granted within the Socratic dialogue and the post-modern conception of parody). In synthesis, in order to sustain the assumption that Pulp Fiction (1994) configures itself as a post-modern exponent, this research relies on the critical thoughts from authors who worked both with film and intermediality theories, as with language and post-modernity theories, such as Mauro Baptista Vedia (2010), Linda Hutcheon (1991) e Mikhail Bakhtin (1984).

Os efeitos da crise financeira mundial de 2007/2008 sobre o sistema bancário brasileiro e seus determinantes
This dissertation is a study about the effects of the crisis of the 2008 global financial system on the structure and functioning of the brazilian banking system. This crisis affected the international financial system and led to the closure of banks in the United States of America and other national economies. The downfall of the crisis, according to some economists, was the fall in home prices in the united states, which had been occurring since the early 2000s. At the center of the crisis were institutions that engaged in high-risk mortgage loans of subprime. This phenomenon led to a global recession, leading governments to intervene to save institutions that were suffering from the inability to honor their contracts and assets, thus facing a systemic crisis that has since been installed. Despite the contagion effect on the world financial system, we suggest that the impact of the crisis on brazilian banks was not so devastating. This is due to the fact that the brazilian government promoted a restructuring of the banking system of the brazilian private sector well before Proer (program to stimulate restructuring and strengthening of the national financial system)

Nazaré Oliveira: uma educadora marajoara
This research, entitled Nazare Oliveira: a marajoara educator, draws a cartography of the personal and professional history of Maria de Nazare Barbosa de Oliveira, or teacher Nazare Oiveira as she is best known at the city of Breves, Marajo, state of Pará. The investigation was guided by the question: who is Nazare Oliveira and which are the legacy of her productions and mediations on education/art/culture on the city of Breves? Her work as educator, researcher, folklorist, writer, composer, artist, poetess and producer of cultural events at this city from the early 70´s to the middle of the last decade of the 20th century, was done by interviews and documents. Are presented, as well, part of her visual work based on the photographic collection organized by her during the period that she run the extinct Cultural Division, a cultural section of the Secretary of Culture and Education of Breves. The interpretation, based on the interviews with the persons that shared experiences at different areas and times with Nazare Oliveira, points out the resonance of her educational actions that still echoes at Breves at the present time. Emphasizes the personal and professional identity of Nazare under the studies of Antonio Novoa (1995,1997,2007) and Paulo Freire (1967,1981,1997,2000). Other theorists such as Barbosa (2008,2009, 2010), Martins et al (1998,2012, 2013), Dewey (2010) supports the analysis in art/education and cultural mediation. Concludes, defining that the relevance of the cultural and artistic productions of Nazare Oliveira at Breves, and the positive influence over the persons that learned with her, still have strong cultural and social resonances nowadays at local art, art/education and the formal and informal education.

Os impactos da doutrina neoliberal sobre a estrutura normativa pós constituição de 1988
A presente pesquisa tem como escopo as reformas impostas à Constituição Federal de 1988, baseadas no discurso neoliberal de que estaríamos em uma nova fase capitalista, na qual os ditames desenvolvimentistas não mais se encaixariam. Para isso, faz-se um estudo histórico, que percorre desde os antecedentes do neoliberalismo, abordando o “consenso keynesiano”, o sistema de Bretton Woods, desenvolvimentismo latino-americano, a crise da dívida externa, entre outros aspectos. Após isto, a passagem do neoliberalismo como ideologia restrita ao ambiente acadêmico, até ganhar ares políticos ao ser adotado pelos países centrais. Na última etapa histórica, a chamada Segunda Grande Transformação do capitalismo em que se dá três fenômenos: globalização, neoliberalismo e a reestruturação produtiva. Finalmente, o objeto principal do trabalho é a transformação do Brasil em uma plataforma de valorização financeira, possibilitada pelo próprio período industrializante. No âmbito jurídico, a necessidade de reformas neoliberais sobre a Constituição Federal, sendo encarada como um bloqueio à valorização do capital financeiro, este, por sua vez como soberano, viabiliza tal processo mediante a instalação do Estado de exceção permanente no país.

Este trabalho tem como objeto o território do Córrego do Carandiru e seus arredores, do Parque da Juventude até as margens do Rio Tietê, localizado na zona norte da cida de de São Paulo, pertencente a prefeitura regional de Santana/Tucuruvi. O estudo se deu através da análises de dados históri cos, de questões políticas e ambientais, bem como o estudo de projetos antes realizados para requalificação da infraestrutura verde e morfologia urbana da cidade de São Paulo, retomando a relação do homem com a água. Os vestígios dos corpos d’água que deixaram de integrar a paisagem das grandes cidades são o argumento desta pesquisa. Diante da complexidade do mundo contemporâneo, há a necessidade de proteger o ambiente e preservar a memória. O objetivo é chamar a atenção para a necessidade urgente de ações voltadas para a revitalização dos rios e cór regos urbanos. Desenvolvimento de competências para a sustentabilidade: uma análise dos discursos educacionais do BCSD Brasil e BCSD Portugal à luz de Derrida
The adoption of the powers of logic to discuss Sustainable Development (SD) in the business environment arises from the concern of developing actions that recognize the strategic environmental issue in the relationship with stakeholders. In this context, Stone (2005) analyzes the emergence and performance of a relevant actor, the Think Tanks, which are groups seeking to influence governments and companies to adopt certain discourses and initiatives. Among these actors emerge those who are engaged in building an agenda for the business world into the DS, as the World Business Council for Sustainable Development (WBCSD). But what sense the educational actions taken by these think tanks take in this process? What kind of skills promote? To answer these questions we chose to study the performance of the Think Tank WBCSD, from Derrida's deconstruction. Took to this discourse and Skills Development Actions for Sustainability (SDfS), held by the Boards (BCSDs) of Brazil and Portugal. The research question that guided this research was as follows: What are the meanings of SDfS initiatives, disseminated by the WBCSD, which are revealed in his speeches and educational activities? In the study of the trajectory analyzed the documents that present the thought of the DS entity (Vision 2050 and Action 2020) in order to understand the discourses and sustainable initiatives. In addition, interviews were performed with Coordinators, Associate Specialists and BCSD Brazil and BCSD Portugal to understand the initiatives and educational activities of DCPS developed by these councils between the years 2010 to 2013. To understand this discursive game developed the metaphor read Think Tanke, used to analyze the performance of the WBCSD, which can develop a "thought armored car" closed the other translations, and/or assume the posture of a moderator speeches, most associated with the "thought tank " Explains that the "tank" is a popular technology that is based on the principles of sustainability and is applied in the Northeast of Brazil through water harvesting during the rainy season, so that the supply times of crisis to use liquid reserved. In this sense, the "thinking tank" is the work of "think tanke " that opens the diversity of opinions and readings in order to develop strategies to act in a sustainable way in times of plenty and in crisis situations. In light of Derrida, the survey results show the ambiguities and the nature of expertise in the speeches and initiatives that predominate in SDfS programs. Values to adapt the business to DS logic in a discursive context that want to build a new relationship between business and society, expressed in the document Vision 2050, but still can not be consistent enough to consolidate an effective change. For the WBCSD go in his ways the entity needs to recognize its responsibility in the concrete and the effectiveness of SDfS initiatives. This finding requires that the entity's educational activities as well as developing skills to meet the urgent environmental crisis, also needs to promote more associated skills to understand a " thought tank" that seek to respond social and environmental issues in their complexity when considering the various translations on the theme.

O aconselhamento bíblico no âmbito religioso e sua aplicação: uma análise entre literatura de autoajuda e a prática pastoral e leiga
To analyze Biblical Counseling in the perspective of Jay Adams we must begin by analyzing the neutral methodology proposed by him. This word has by variant of noutheeth, and is translated by advise. Yet this is much more than just a moment of conversation, the counseling proposed and by him works the exhortation for instruction and correction. This instruction is through the bible which is the Word of God. That's why Jay Adams's Biblical Counseling is all grounded in the Bible, so the counselor does not speak of himself, but conveys biblical principles to his counselor. Already for Edir Macedo's Self-Help Movement, the basis is in Prosperity Theology. The directing of preaching and testimonies that are broadcast on the television and radio media for the primary purpose of offering help to people who are experiencing difficulties, spiritual, physical or material. There is no denying that the aid offered is justified because of the market analysis (demand). In the television media, the channel most engaged with the delivery of religious discourse is Record since the publication known as "Folha Universal" which includes sessions such as "bishop's words" and "miracles of faith" (RODRIGUES, 2002). Jay Adams's Biblical Counseling differs from the self-help movement proposed by Edir Macedo. When comparing the two segments, it is possible to identify elements that constitute Edir Macedo's discourse to the market and ethical ideas that stimulate consumption in contemporary capitalist society. Such elements were not identified in Jay Adams's Biblical Counseling.
