O presente trabalho desenvolve-se através da investigação do Córrego da Água Preta, localizado nos bairros de Vila Anglo, Vila Romana, Pompéia e Barra Funda, na cidade de São Paulo. Esta investigação teve início com o mapeamento da área, o reconhecimento do curso d’água e seus arredores. Procurou-se então identificar os vazios adjacentes a este percurso, que se mostraram sempre presentes, do início ao fim deste trajeto. A ação constrói-se como intervenções nestes vazios, na tentativa de revelar esta camada oculta, o córrego que hoje apresenta-se quase que completamente invisível no espaço da cidade. Estas intervenções estão associadas a ações específicas: adição, suspensão, movimento, subtração, tensão e revelação. Como mecanismos que trazem a água à tona no espaço público, estas ações estão associadas a acontecimentos, programas, vocações. Ao mesmo tempo que revelam as relações entre si, as intervenções apresentam-se independentes. Descrevem uma sucessão de pontos, cuja hierarquia não está determinada. Não há aqui a pretensão de determinar um percurso. Este surge somente devido ao elemento oculto que unifica as ações: o córrego. Tratam-se de hipóteses diferentes acerca do mesmo tema, e se desenvolvem em equilíbrio com a fundamentação teórica. Busca-se aqui apresentar estes relatos de maneira semelhante àquela em que foi desenvolvido o trabalho. Não há pretensão de hierarquizar o que aqui se apresenta, sendo possível escolher um caminho de leitura, ou qualquer outro. Tratam-se de duas instâncias a serem descritas: aquela referente às ações e aquela referente aos temas de referencial teórico. Como duas histórias contadas em paralelo, as páginas do lado esquerdo abrigam as ações, em folha na cor azul, e aquelas do lado direito abrigam o referencial teórico. Procura-se aqui não somente apresentar duas linhas de raciocínio, mas os momentos de cruzamento entre elas

Este trabalho tem por objetivo analisar os fundamentos jurídicos utilizados pela doutrina e pela jurisprudência acerca da aplicação supletiva da Lei das Sociedades Anônimas às limitadas (Lei n. 6.404, de 15 de dezembro de 1976), fundada na faculdade prevista no parágrafo único do artigo 1.053 do atual Código Civil de se estabelecer, no contrato social da sociedade limitada, a regência supletiva pelas normas das sociedades anônimas, e não pelas regras das sociedades simples esculpidas no Código Civil, em caso de omissões no contrato social ou no capítulo reservado à sociedade limitada no Código Civil. Pretendeu-se esclarecer a dúvida acerca da necessidade de, em caso de omissão das regras do capítulo próprio das limitadas, ou do contrato social, recorrer-se, primeiramente, às normas das sociedades simples dispostas naquele Código ou, se permitido pelo contrato social e havendo compatibilidade entre os institutos dos dois tipos societários, socorrer-se diretamente das normas das sociedades anônimas. Para tanto, foram analisados alguns aspectos históricos, como o entendimento da doutrina e da jurisprudência na vigência do Decreto nº 3.708, de 10 de janeiro de 1919, que introduziu as chamadas sociedades por quotas de responsabilidade limitada no ordenamento jurídico  Graduanda em Direito da Faculdade de Direito da Universidade Presbiteriana Mackenzie. No entanto, foi demonstrado, no decorrer deste trabalho, que, na constância do atual regulamento jurídico das sociedades limitadas, as dúvidas sobre o tema não foram solucionadas, pois o tema da regência supletiva das sociedades limitadas ainda gera divergências de opiniões, tanto no âmbito doutrinário, quanto no âmbito jurisprudencial.

Title: Redesign of operational processes at the insurance company Cardif in search of higher priority Keywords: Competitive advantage. Process Review. Insurance Market. Claim Process. Value creation. Introduction: the present project aims to analyze and propose a solution to a problem identified in the insurance claims opening and regulation process of insurance Cardif, which it provides is a bureaucratic process and with communication problems, in order to create value for policyholders and the competitive advantage. Methodology Used: The method of solving problems and taking advantage of opportunities proposed by Marcondes, Miguel, Franklin and Perez (2017). Investigated Context: With the ease provided by the use of technology, according to the expectations and needs of growing customer clients, putting pressure on companies in general to offer faster, simpler and more specific services. In the case of insurance companies, this has also been happening, leading them to review their traditional business model and to look for ways to adapt to the new requirements of customers, with a focus on innovating, winning, retaining and promoting smart solutions and services to customers. This paper presents the technological report of the steps taken by the insurance company Cardif in order to meet these new demands from customers. Diagnosis of the Situation: The diagnosis was started by assessing the perception of the quality of its services together with its security base, followed in agreement with managers and business partners. The problem was defined as the need to improve and redesign the claim process, not only to make the process more efficient, but also to create value for policyholders and other stakeholders. Proposed Intervention: The project gained visibility and importance in BNP Paribas Cardif, in the company's strategy, in reducing the payment period for settlement of claims and customer satisfaction. After the project gained importance and visibility in the company, it was prioritized with the start of development in the second half of 2021. Result Obtained: Although the implementation of the project was delayed by the pandemic, the project is approved and structured and can differentiate BNP Paribas Cardif and reinforce its position as one of the most important players in the sector.

The mechanisms for managing evaluation and analysis of writing are strategies that may help to follow the tracks of information generated throughout e-learning courses. In this research, we detail the course of techniques application and presentation of results by means of reports. Such presentation was conditioned to the set of themes and to the evaluation criterion of Discussion Forum, which was restricted to the development of a set of analysis techniques about data generated in on-line courses interactions of a school institution, in order to enable the visualization and provide conditions to evaluate the quality of posts, as professors/tutors face di culties in following the discussions due to the quantity of interactions. For this reason, this study adopted as strategy a qualitative and quantitative approach that aimed to analyze both quantity of posts of 841 participants of 18 classes within the discussion forums universe where we may nd problems, and quality of students comments during the analysis, by checking if they were suitable and if they met the objective proposed. The objective of this research was extracting comments and having relevant information about the posts. To achieve this purpose, it was developed a set of techniques in an R Markdown le to present reports with results of the evaluation based on Data Mining (DM), speci cally Text Mining (TM) and exploratory analysis, whose investigations were summative and formative. In this way, we hope that the action developed in this research may support managers to analyze students contributions and follow the work of the professional in charge of class learning. The methodology showed and the indexes used may be applied in any type of text database.

The business scenario goes to a greater or lesser extent through a transformation movement, characterized by borderless competitiveness, consolidation of sectors of the economy, innovation movements marked by the emergence of new entrants (companies and business models), increased awareness and customer requirements in relation to products and services that are offered, development of new corporate skills. As a consequence, professionals have been increasingly required to achieve goals and targets towards achieving results, in this environment ruled by uncertainties and volatility, which may generate imbalances and instabilities in the issues related to the physical and mental health of these professionals. In this context, Medquality stands out as a company in the occupational health and safety sector, recognized for the quality of services provided, and aims to improve its offer to the market, taking advantage of existing opportunities, based on the development of an action format that allows to reach a better offer of perceived value to its current and potential customers. An analysis of the organizational structure of the company, its internal processes and the current value chain was considered. The diagnosis made through a market study, allowed to deepen the understanding and obtain the mapping of the opportunity to be reached. After completing this step, strategic planning and value creation analysis tools were applied that allowed a better identification of business expansion alternatives. The proposed solution contemplated the integrated management of technology and relationship in order to obtain improvements in the provision of services. The company's value chain was revised and expanded, and implementation risks were identified and mapped and a plan of action was created to mitigate these risks. The proposed model sought to identify and develop a solution that not only addressed the aspects and needs pointed out by the market study, but that its application and replication in different segments and clients was feasible regardless of its characteristics and particularities; however, it also sought to apply process innovation through a more humanistic approach to interpersonal relationships of greater proximity and effectiveness in the clinical treatments of the cases identified. The complexity of the proposed solution is based on the integrated coordination of aspects related to technology / project management through the implementation of the integrated management system (SGI), and the management of the cultural and behavioral factors involved, through the Advanced Health and Safety Program (PASS). Medquality´s results are expected to be improved by increasing revenues and operating margin, expanding customer satisfaction and the scope of services provided. The monitoring and achievement of the results to be obtained with the implementation of the proposed solution will be monitored through the management of indicators defined in the BSC Balanced Score Card, aiming at achieving the main objective of this work, which is to create value for Medquality’s clients, through their needs and expectations, contributing to a better welfare and quality of life of the professionals of these clients.

This dissertation considers the possibilities and potentialities of “a museum outside a museum”, and selects as its main study case a public transport equipment which traditionally offers cultural and artistic entertainment to its users: the São Paulo Subway Company (Metro-SP). Three complementary research approaches are considered. The first is a theoretical one, considering the subject of art and culture in the city’s public space, as opposed to the enclosed spaces of a traditional museum. The second is a historical one, revising the main artistic and cultural actions carried out by Metro-SP in the last fifty years, considering its objectives as stated in bibliographical sources and by collecting oral depositions of the company’s employees. The third is an empirical research, getting to know and recognizing several artists’ works displayed inside the subway stations, “Subway Art” program, though systematic itineraries, organized as to observe the monthly exhibitions, “Culture Line” program, in order to observe its public or “non-public” and how they relate to that art and culture free offer in their daily routine. Finally, it suggests some interpretations regarding the “museistic” aspects of this study case and some of its possible consequences.

Con el título Elementos de la Soberanía y del Tribunal Penal Internacional buscamos demostrar la ligación y puntos conflictantes entre el poder soberano y la Corte Internacional Criminal. En el capitulo I, abordamos el concepto de soberanía y su enfoque de concepción política, realizado por Jean Bodin. Vimos el Estado-Leviatã de Thomas Hobbes y la soberanía inalienable e indivisible de Jean-Jacques Rousseau. La relación entre Umberto Campagnolo y su profesor, Hans Kelsen, también fue abordada, notadamente en lo que dice respecto a la soberanía y en lo que cada uno de ellos piensa sobre el tema. Analizamos, todavía, los atributos de la soberanía y las teorías de la soberanía del rey, dela soberanía popular, parlamentar, nacional y del Estado. Abordamos las limitaciones de la soberanía y su ligación con el mundo globalizado. Al fin del capítulo disertamos sobre la soberanía brasilera. Iniciamos el capitulo II con los precedentes históricos del Tribunal Penal Internacional, al estudiar el Tribunal de Leipzig y el Tribunal de Nuremberg. También fue analizada la creación del Tribunal Penal Internacional por el Estatuto de Roma, sus ligaciones con los derechos humanos, bien como fueron enfocadas su jurisdicción y relación con la soberanía. Tejemos, todavía, el análisis de los casos de inadmisibilidad de juzgamiento ante la Corte Internacional Criminal y los casos de no-confiabilidad" y inhabilidad de las jurisdicciones nacionales. El capítulo fue finalizado con el estudio de los crímenes de competencia del Tribunal Penal Internacional. En el último capitulo, discutimos la interfaz enter la Soberanía Brasilera y el Tribunal Penal Internacional, a través de los confrontes de normas del Estatuto de Roma con la Constitución Federal de 1988. De esta manera, buscamos contribuir con la línea de pesquisa - a ciudadanía modelando el Estado al presentar, ante esa Digna Banca, el trabajo: Elementos de la Soberanía y del Tribunal Penal Internacional.

Research Objeticve: The objective of this applied research is to develop and propose a work methodology based on agile methodologies for the delivery of the tax ancillary obligations of SPED in the Demanding Company. Design / Methodology / Approach: This study is classified as an action research, with a qualitative approach based on observation and survey on the current methodology of elaboration and delivery of SPED's ancillary obligations and its main problems on DC Practical implications: The practical implications of this research are related to the use of a work methodology based on agile methodologies in teams of interdisciplinary and selfmanaged characteristics, aimed at the continuous improvement of the processes for the elaboration of the accessory tax ancillary of the DC. Originality and Contributions: The new agile fiscal methodology will allow the DC to reduce the problems of elaborating SPED's ancillary obligations, improving communication between employees, cooperation between teams and improving control of personnel costs and deadlines for preparing and delivery of ancillary obligations. Results: The results of this research in the delivery of ancillary obligations of SPED are: reduction of overtime, compliance with ancillary tax obligations related to SPED within the period determined by law, improvement in the quality of information on ancillary obligations and reduction of tax penalties in the DC.

The innovations in the exercise of citizenship after the evolution of technology lead to reflections in the Law area, concerning information, liberty of expression and respect to private life. The use of cyberspace as a way to practice juridical acts was transformed by the creation and popularization of internet, which made possible the information process as no other way of communication could ever have done, due to the fact that it allowed people to inform, be informed and keep informed in an easier way. The modern conception of citizenship requires, not only solidarity to demand the rights for which the whole society is interested, but also covers the needing that all people have access to technology, otherwise it would make very difficult to exercise their rights. Inserted in the research area Citizenship Modeling the State , due to the needing of revision and consolidation of the concept of citizenship and the rising importance of the right to information, when internet plays a preponderant role on citizens life, the objectives of this thesis are: to analyze the role of the right to information on the cyberspace, reflecting about how it models the performance of the State and leads to the exercise of an active citizenship, modernizing democracy, and also to evaluate if this right is present in the construction of the rules for a civil regulation of the internet. The methodology comprehended a documental research, using both national and foreign literature, and also the current legal rules, the Law Project (and Substitutive) that intends to create the Civil Regulation of Internet and the case law, based on the literature of authors such as Alexy, Bucci, Castells, Dahl, Dworkin, Lévy and Pinsky. This thesis was divided in three chapters: the first one regards the transformations of society, related to the right to information; the second one studies the internet and its role on the exercise of citizenship; the third one analyzes how the creation of a civil regulation of internet in Brazil may promote the exercise of the right to information and consolidate citizenship. It was supported that the rules regarding the exercise of the right to information and applicable to the cyberspace of internet may consolidate citizenship, concluding that the Law Project 2.126/11 (and Substitutive) contains the main rules in order to cover these objectives, as an effective public policy related to the exercise of citizenship.

Digital games make use of the principles related to the concepts of persuasion, motivation and engagement, principles that are often applied intuitively and unsystematically in the game design process. However, these principles are not always followed, they need more precise definitions, as well as a systematization. Therefore, this thesis aims to propose a framework called PerMotivE (Persuasion - Motivation - Engagement), formed by three components: the first is a conceptual model, called PerMotivE Model, whose objective is to define guidelines and relations between these bases in a systematization of the concepts persuasion, motivation and engagement based on a literature review; the second is a software architecture proposal that aims to support the use of the framework, this component is called PerMotivE Maker; the third component of the framework establishes a set of elements that make up a simplified GDD proposal, called PerMotivE Artifacts, making available the artifacts used in a game design, analyzed by means of Bayesian networks, as to its adherence to the proposed guidelines in the conceptual model . Based on the components of this framework, a web application was developed with the aim of evaluating it together with a limited group of designers to evaluate its pertinence in the elaboration of some game designs. These designs were evaluated qualitatively and quantitatively in order to verify the relevance of the framework. It has been found that the conceptual model can help designers to understand the principles that influence, motivate and engage players in games. It was also noticed that some guidelines could not be evaluated due to the inexistence of game prototypes analyzed through their designs. It has also been found that the application developed for the tests can be expanded to assist the game design process more broadly. In general, the framework was adequate for the purpose of evidencing the principles related to persuasion, motivation and engagement that can be worked on in the game design process from its artifacts.
