Em suma, o presente trabalho teve como escopo o estudo da paternidade socioafetiva e as consequências jurídicas advindas de seu reconhecimento. A pesquisa, além de elencar pareceres doutrinários e jurisprudenciais recentes, deu enfoque à relevância do tema sob a ótica constitucional e registral, traçando um histórico de leis e medidas judiciais pertinentes. Registre-se que, em que pese não haja no ordenamento jurídico conceito ou definição legal da parentalidade desenvolvida tão-somente nos laços de afeto, não mais se ignoram os efeitos dela decorrentes. Nesse sentido, a repercussão jurídica obtida a partir da configuração da posse do estado de filho, o entendimento do registro como instrumento declaratório de paternidade e a participação na sucessão e o direito à herança, mesmo ante à ausência de registro em hipótese de falecimento dos pais socioafetivos, foram alguns tópicos abordados em profundidade por meio desta monografia. Outrossim, restou analisado o embate entre a socioafetivade e a consanguinidade, nas hipóteses em que, ao invés de caminharem juntas, se encontram uma de frente para a outra, litigando direitos e deveres. Com o advento da Constituição Federal de 1998 e com as transformações legislativas dela decorrentes, sobreveio a igualdade entre filhos, que culminou na valorização dos laços afetivos e na consequente “desbiologização” da parternidade. Com efeito, conferiu-se ao Direito um caráter mais plural, inclusivo e menos normativista, seletivo. Daí porque, migrou-se da categoria do “Direito de Família” ao “Direito das Famílias”, como sendo hoje uma esfera de acolhimento, benevolência, apreço e, sobretudo, humanidade.

This work unfolds in three stages. The first addresses the relationship between the mode of production and therefore of socialization of individuals in this moment of contemporary capitalism with the concepts of Ideology, Ideological State Apparatuses (IEA), and the impacts that cause in individuals and their relationships. The second part focuses on how the media (one of IEA), particularly the means of communication, affects the social reality and the interaction of these individuals with this social environment, specifically in what concern our representative democracy. Finally, the third stage, more empirical, will be studied the media reality of Brazil, the concentration of power that occurs in a means of social communication, broadcasting service, specifically the issue of broadcast TV concessions, and the way that gives the exploitation of this public good by oligopolies.

This dissertation focused on studying the relationship between business risk and leverage of Brazilian companies. To this end, six variables were used to represent the business risk (standard deviation of ROA, standard deviation of log of sales,standard deviation of changes in operating income, the unlevered beta, the cyclicality and the operating leverage) and five index of debt (total debt, short term debt, longterm debt, financial debt and net debt) calculated at their book and market values. The method used in the study for the treatment of the data was the panel data and the model that was used to estimate was the static panel. Among the results obtained by the regressions performed, some to be emphasized were the negative relationship of the standard deviation of ROA with financial debts and net debts, the negative relationship of the standard deviation of the log of sales and the standard deviation of the change in operating income with variables of debt in book value and the unlevered beta negative relationship with the variables of debt in market value.This study concluded that the risk of business is relevant to decisions about the capital structure of companies.

The paper presented on the following pages has as its theme the way the comments made on the internet are composed, specially on journalist Leonardo Sakamoto’s blog and facebook page. The gols of the present paper are: to show how the discourse in shuch comments are built; to show that such discourses are not Always responsive to the posted one and, most of the times, they do not admit a response – they are, therefore, monophonic and authoritative; to discuss about online interactivity in order to verufy whether such discourses are, in fact, interactive or obtuse speeches, ones that silence others and point to prejudice and intolerance, which can be found in some comments. The French Semiotic Theory was the main basis to the discourse analysis. On the intolerance topic, the works of Barros about the constitution of prejudiced and intolerant discourses were mainly used. The discursive procedures and the dialogic relationships in the main texts and in the comments were analysed, and the corpus is constituted of three texts published by Sakamoto on his blog and four comments for each text, a total of twelve studied comments. They were divided into four categories: it disagrees with the journalist and attacks him personally; it disagrees and refers to the arguments; it agrees and praises the journalist personally; and it agrees and refers to the arguments. Through the discursive analysis, it was possible to identify the above mentioned characteristics, which constitute such texts, their interactive relationships, and discuss the issue of interactivity and intolerance on the internet.

The need, or not, of implementing affirmative action policies directed towards social and economical inclusion of socially excluded groups in the Brazilian society, among which the afro-descendents stand out, has been widely discussed. However, the debate over this implementation, or not, of affirmative policies has gathered much more attention from thinkers connected to the sociology and history areas than from thinkers connected to the juridical branch, and that is why the juridical argumentation derived from these discussions has proved exceedingly in lack of more serious and deep intellectual formulation. There has been some exceptions, that is true, but as a rule the current academic reality, preponderantly technical, tends to relegate the best studies on this theme to a second plan, in which the conclusions obtained, as well as the eventual proposals presented, end up being put aside, without even being examined by the government. The present essay has as its objective to add up to the theme debate, focusing, in a first moment, on the facts pertaining the historiography of the negroes and their descendents, and in a second moment, on the sociological studies pertaining the integration of this social group to the other preponderant groups of society, to culminate with a debate over the affirmative actions application, this debate being supposedly supported by the pre-juridical elements that would legitimate its implementation.

This essay is the product of a research on Arts methodology of education, which presents a new paradigm on the education of this knowledge field. Such paradigm introduces images in the classroom and is not exclusively worried about making the studio s works. There is a preparation in order to analyze and understand images before producing a poetical response. The objective of this research is to put the Triangular Proposal into practice, declared by Ana Mae Barbosa, aiming at the development of abilities for the appreciation, contextualization and elaboration of poetical proposals for the high school pupils. The presented theory is based on the Triangular Boarding which has three components: reading (Critical and Aesthetic), contextualizing (History of the Art) and working in studio (Artistic Education). The complete knowledge of this theory happens when such components are carried out simultaneously. The methodology of this research is qualitative, descriptive and exploratory, using the Research-action as theoretical basis. In the present research, the pupils, based on the reading, analysis and contextualization of the works of the Pinacoteca do Estado de Sao Paulo s collection have produced poetical responses through plastic arts, reinterpreting and giving new understandings of the original works.
