This study addresses the evolution of some institutions, realities of social coexistence, including citizenship and fundamental freedoms, lifted up as an constitutional ballast, as a precondition for human existence and social order. It examines the role of the state and its performance under administrative control specifically in the exercise of those freedoms, through the so-called police power. Thus, it begins with a historical perspective of citizenship, under various doctrinal issues. Following it approaches the assessment of citizenship in the Federal Constitution, specially in the fundamental rights, emphasyzing freedom and property, the specific objects of administrative restrictions. It develops the concept of state and its goals, discuss the government and their functions, among which is the police power. Next, the study deals with the evolution of the power of police, their main doctrinal characteristics and attributes, through critical analysis in its application and influence in society. Finally, we conclude the research identifying opportunities for participation of citizens in this zone still restricted entirely to the interference of the state as trustee.

Our goal is to discuss the Sparse City through the actions of the Real Estate Segment with no pretension to exhaust this complex topic. From the premise that the city should be seen as a market’s byproduct to understand the valuation of urban land and its occupation. Our focus is the Urban Cluster of Jundiaí. For its economic dynamism and urban sprawl this area is part of the state planning virtual territory of the São Paulo Macrometropolitan Area. The data presented here outlines the urban landscape during the verticalization process of core municipalities, more specifically in the consolidated urban areas. These core municipalities are spreading the borders through the horizontal real estate, IE, through the deployment of subdivisions and housing developments on its fringes. This process produces and disseminates the ideas which aim to hide the real production processes of uneven urban spaces, sells the image of the new, the novelty in the style of life and how to live, when in fact express the old forms of ownership of the urban landscape. This work seeks to discuss the criteria and consequences of using old instruments of division of land, based on a speculative culture generated by both public investment and the real estate capital. These two old forces are responsible for the cities we live in today and that reproduce continually a model that does not help the quality of life of its inhabitants. Finally, using the information obtained from the GRAPROHAB (the state agency that oversees the licensing of all housing) public and private enterprises, it is possible to show the trend in vertical integration in the most dynamic and prosperous cities as a decisive factor for the spatial segregation of urban land.

O presente artigo tem como objetivo analisar a imagem da mulher nas campanhas publicitárias contemporâneas e a forma como a publicidade se apropria da sua imagem para persuadir o seu público-alvo. Buscando refletir de que forma as marcas, principalmente em propagandas de cerveja, erotizam e sexualizam o gênero feminino e, qual é a atuação do CONAR nesses casos visando a proteção legal à mulher. Por fim, conclui-se pela imprescindibilidade da atuação do órgão autorregulamentador nesses casos e, ainda sugere-se que o Ministério Público do Trabalho deva atuar nesses casos propondo ações com força de decisão coercitiva.

O presente trabalho analisa o princípio constitucional da razoável duração do processo, sua disposição constitucional e infraconstitucional, dando destaque para os benefícios que artigo 4° do NCPC trouxe aos jurisdicionados, ao dispor em norma infraconstitucional, o que já era garantido em norma constitucional. Analisa-se princípios processuais constitucionais correlatos ao princípio da razoável duração do processo, o dever de indenizar do Estado, em virtude da demora excessiva do processo. Bem como, o comportamento do jurisdicionado dentro do processo. O caminho que a jurisprudência tem seguido para conceituar razoável duração do processo, e a aplicação na prática do art. 4º do NCPC.

A Lei nº 13.441/2017 regulamentou a infiltração de agentes na internet. A infiltração de agentes é um tema ainda recente que se iniciou de forma efetiva com a Lei nº 12.850/2013. Este texto tem como objetivo apresentar as mudanças no Código Penal e principalmente no Estatuto da Criança e Adolescente, relacionando com as normas positivadas na Lei nº 13.441/2017 referente a regulamentação da infiltração de agentes na internet e a taxatividade dos artigos de lei que permitem a atuação do agente infiltrado. A análise deu-se por meio de comparação a Lei nº 12.850/2013, a qual prevê a infiltração de agentes em organização criminosa. Apesar de recente, a lei mostra-se deficitária em esclarecer determinadas formas de infiltração e a permissividade da prática de crimes pelo agente infiltrado, sem que haja limites para sua atuação. Além disso, verifica-se que a Lei nº 12.850/2013 seria suficiente para regulamentar a infiltração de agentes na internet e o combate ao crime organizado, ainda que o objetivo seja a produção de provas de infratores que talvez não sejam pertencentes à organizações criminosas.

This study analyzes the knowledge management in Radiology Services. Through a theoretical revision inspired in the Resource Based View, the knowledge can be interpreted as a resource, with high potential to generate competitive advantage to its organization. In order to make possible that the competitive advantage generated by the organizational knowledge be sustained through time, this resource needs to be managed. The healthcare area, as it is intensive in knowledge, needs strong efforts to manage its knowledge, what justifies the choice for this area. Knowledge Management is, so, analyzed regarding two criteria: the conditions the organizations offers to develop knowledge internally, what is based on the Enablers Conditions described by Nonaka and Takeuchi (1997); and the Knowledge Management practices, based on Alavi and Leidner s (2001) process vision. Using descriptive research and data collected among radiologists, results were obtained to verify, first, the existence of the mentioned criteria in the Radiology Services, and second, if there is association between the two criteria. The results informed that Conditions Intention and Autonomy , clearly exist in the organizations, and Conditions Fluctuation and Creative Chaos , Redundancy and Variety of Requisites appeared only partially in their reality. The Practices Creation and Transference were clearly identified, but the Practices Retention and Application were only partially recognized. After establishing two clusters that represent a group with high level of knowledge management practices adoption and a group with low level of knowledge management practices adoption, the association between the groups and the Enabler Conditions was significant, refuting the hypothesis that this relation would be inexistent.

Nowadays, the universe of adapted sport has emerged for athletes seeking a constant overcoming in the sporting context, but they must be motivated for sports practice, for competitions and above all for overcoming defeats or maintaining victory. In this perspective, the present study had as main objective validate the Task and Ego Orientation in Sport Questionnaire (TEOSQ) for the Brazilian population of paraathletes, physically disabled, testing the psychometric properties (validity, reliability and reproducibility), Establishing a score related to the instrument studied, thus enabling a description of the level of motivation (task orientation and ego). Through a descriptive quantitative approach we evaluated a sample of 771 para-athletes over 18 years of age (mean of 29.51 years [± 9.65]) of both genders, randomly selected. After the approval of the Research Ethics Committee, the contact with para-athletes was initiated via the Brazilian Paralympic Committee and personally in regional, national and international competitions. Subsequently, the pilot study was carried out with 47 para-athletes with a mean age of 29.42 (± 9.00), which positive results of TEOSQ were identified in relation to internal consistency and correlation with POSQp. From these results, we proceeded to the complete study that counted on the participation of 771 para-athletes from different Brazilian States, following the same steps of the pilot study. The results pointed to the high consistency of TEOSQ in relation to task orientation and to ego (task alpha of 0.82 and ego of 0.77). The only exception was in relation to question 6 (The others mess up and I do not), specifically in ego orientation, since the statistical modeling of internal consistency and exploratory factorial analysis (AFE) revealed that this question was dissociated from the ego factor, revealing A third factor. In the test-retest test, the results confirmed the internal stability of the instrument, and the explored factors were associated with latent values in the guidelines, except for question 6, where the AFE model suggested a latent third factor. The results pointed to the high consistency of TEOSQ in relation to task orientation and to ego (task alpha of 0.82 and ego of 0.77). The results of this research allow us to conclude that TEOSQ has adequate psychometric properties to evaluate motivation among Brazilian para-athletes, according to different validation strategies. At the same time, the analytical models performed in the research indicate the withdrawal of the issue of number 6, since it would lead to the improvement of the instrument. Another finding of the study was that para-athletes have motivational tendencies of the task-oriented type, revealing their concern to learn, develop, and cooperate with team partners, believing that their success results from their effort/ training and personal achievement, not randomness.

This study aims to evaluate the control and supervision of investment process of pension resource by the Pension Funds whose purpose should be to ensure the future payment of pension contracted by the participants. The Pension Funds are overseen by Previc and should have enough internal controls and governance to avoid actuarial deficit in the benefit plans that manage. The lack of control can lead to civil and administrative liability for entities, its officers, sponsors and other entities in the market who advise Pension Funds on the implementation of the investment process. The ascertainment of liability of the entities and its officers, within the Previc, begins with an administrative process that clears irregularities. After administrative level, who feel harmed can start a lawsuit. Despite the strong accountability framework of guilty, which should pursue is effective compensation of benefit plans arising from damage caused by mismanagement of resources that will complement the future income of the worker at the time that their workforces are reduced. The employee, who expects to receive his supplemental retirement, is the keystone of the closed private pension market.

This final project, according to the approach and methodology for the development of practical and applied work prepared by Marcondes, Michael, Franklin and Perez (2017) describes the problem solving in materials management in a logistics operation in a packaging company with high complexity and scale of production, with exclusive items from competing customers. Were identified fails in the inventory count controls, organization, layout, measurement tools, and technology definitions. In this way, a mapping of the operation was carried out and a plan was drawn up with proposals for solutions to the problem, in order to correct the failures that lead to the nonconformities of the material control. The actions have focused on the management model of the materials, applications, physical distribution, counts model and transaction validation logic. It was also considered technology implementation alternatives, such as RFID, WMS and UAVs as well as the application of training, professional development operational teams, and awards, recognition and implementation of a systemic process. During the process of innovation and construction of the final Project, a visit was made "in the field" for the validation and technical testimony funding for the foundation of the concepts that guided the proposals. In this way, the experience acquired in this work can be shared and replicated, for its future applicability, serving as the basis for the decisions of other companies of the same or different segments.
