Políticas públicas de controle da corrupção e da lavagem de dinheiro no Brasil: um panorama institucional

Considering the expansion of organized crime, and mainly of money laundering and corruption, as a consequence of the globalization process, as well as the serious effects that this type of criminality has in the development of the States, the present essay considers the idea of the necessity of Economic Penal Law protection in this area. Moreover, it is recognized that the prevention and the repression of these crimes will only be possible through the implementation of effective public policies of control, which depends necessarily on strong and independent institutions. In the view of these premises, the essay aims to design an institutional scenario of money laundering and corruption control policies, in order to observe success issues that could be replicated, as well as identify possible weaknesses that defy its effectiveness. Hence, it was theoretically addressed the definition of institution, based on the legal institutionalist ideas, through confrontation between the understandings of Hauriou and Santi Romano. Once adopted Romano’s perspective, in which the institution is considered an organized entity and observed its relevance in the public policies determination, the essay then realizes an analysis of the institutional evolution of the public policies studied in Brazil. Proven the advance in normative area and the creation of several organs and institutions which aim to control corruption and money laundering in the last decades that led to the development of a multi-institutional model (which presents advantages and disadvantages), it is then, realized an critical analysis of each main institution involved in this process (MP, PF, TCU, CGU, COAF and ENCCLA), in order to verify the best way to build an institutional arrangement capable of reduce the disadvantages of this model. Finally, in regard to the conclusion, it is presented the main positive characteristics and the weaknesses of these institutions, as well as recommendations in order to replicate strategies and overcome challenges related, principally, to coordination and articulation of the multiple institutions, and the risk of capture and political influences which are critical issues verified in all the institutions under analysis. It should be noted that the observance of the mentioned issues is essential so that the money laundering and corruption control public policies are not contaminated by the consequences that derive from these weaknesses and then become effective.

Direito penal do inimigo: uma análise sob os aspectos da cidadania

This work has as main theme the analysis of the Enemy´s Criminal Law theory reformulated by Günther Jakobs. For both, there was an examination of theories of Penalty and located to the Criminal Funcionalism of Jakobs among the theories of General Positive Prevention. Done this, it is analyzed the characteristics and fundamentals of the Enemy´s Criminal Law and its insertion in phenomenon known as Expansion of the Criminal Law. Subsequently, it was made a study of philosophical assumptions that underpin this doctrine, especially as regards the ideas of Rousseau, Ficthe, Hobbes and Kant. Finally, drew up the historical development of Citizenship, delimit up its content and its incompatibility with the Enemy´s Criminal Law.

O trabalho versa sobre negócios jurídicos processuais. O tema é abordado por uma perspectiva histórica, atrelada ao posicionamento entre o publicismo e privatismo. Praticamente inóspita, retoma-se o assunto no século XX pelos estudos da doutrina alemã. Diante desse patamar, verificamos que o tema não é tão abordado na doutrina brasileira, contudo, em uma mudança de cenário, o ordenamento brasileiro com a prática forense possibilitaram a negociação processual típica, tendo sido, recentemente, consagrada a clausula geral, com o advento do Código de Processo Civil de 2015. Basicamente, respeitado o pressuposto delineado pela lei processual, a clausula geral possibilita que as partes delimitem ônus, deveres, obrigações, faculdades no campo processual, com vistas a garantir o autorregramento da vontade das partes. O instituto é conhecido e, para tanto, é sopesado as limitações que tanto os jurisdicionados quanto os juízes devem adotar para a correta aplicabilidade. O negócio jurídico, portanto, tem por finalidade flexibilizar o procedimento para atender os interesses das partes, desde que, respeite uma relação paritária e isonômica.

Os programas de compliance e o combate à corrupção

O presente trabalho tem como objetivo analisar a eficácia dos programas de Compliance como mecanismo de combate à corrupção. De forma a contextualizar o fenômeno da corrupção, propõe uma análise histórica, econômica e sociais de suas principais causas e efeitos. Na sequência, são analisados os panoramas nacional e internacional da corrupção, à luz dos ordenamentos jurídicos anticorrupção norteamericano, britânico e brasileiro. A partir dessas análises, estuda o papel e responsabilidade social das organizações empresariais na luta contra à corrupção e analisa os conceitos e mecanismos de apuração da efetividade dos programas de Compliance no Brasil como instrumento anticorrupção.

Breve espaço entre cor e sombra: literatura e artes plásticas

The present work aims to analyze the novel Breve espaço entre cor e sombra (Brief space between color and shade) by Cristovão Tezza. The work transits between the literature and the plastic arts, becoming, therefore, essential to conceptualize what art is, understand the paths that it has been covering since early times and to highlight some present marks in the modernity artists artwork. Once the thread of the story revolves around a false head sculptured by the Italian Amedeo Modigliani, through Walter Benjamin s theoretical assumptions, questions as technical reproduction and manual reproduction will be understood. Knowing that the concepts of art permeate the whole novel, the present work has, as reference sources, the works of Mario Praz, Paulo Menezes, Jorge Coli, Alfredo Bosi and Aguinaldo Gonçalves. It will be analyzed not only the concepts of art, but also, the description of the paintings that correspond to the "narrative paintings", present in the novel, paintings these that transform the words into images.

Museu da língua portuguesa: fruição e aprendizagem na relação interativa

This research was developed from an inquietude to investigate the interrelationships of Education, Arts, Culture and Technology in the spaces that go beyond the universe of the classroom. Transformations are investigated in the museum institution, covering the interactive museums, including the Football Museum and the Catavento Museum, preceding the focus of this study which lies on the research in the Portuguese Language Museum. Would it be a cultural mediator through its digital environments and interactive relationship with the public? What is the reaction of visitors when facing the Portuguese Language Museum and its digital environments? To answer those questions, under ethnographic inspiration, the research was conducted involving field observations of environments and visitors, involving interviews with museum professionals, and a participation in different educational activities promoted by the Portuguese Language Museum, besides documental research and research in the cyberspace, through the museum s website and social networks. The registers were made from the language of "words" and "images , analyzed, classified and interpreted from, based on the theoretical study. The wondering and use of the Portuguese language, the interactivity and cultural mediation in digital environments, show that the learning and enjoyment depend on the interest and participation of each visitor of the Museum of the Portuguese Language, which, in its environment and actions invite and provoke their audience to interact.

Understanding other stellar systems is crucial to a better knowledge of the Solar System, as is the study of extrasolar planets orbiting the habitable zone of their host star central to the understanding of the conditions that allowed life to develop on our own planet. Presently there are thousands of confirmed planets, mostly detected by the Kepler satellite as they eclipse their host star. This overload of data urges an automatic data search for planetary transit detection within the stellar light curves. Box-Fitting Least Squares (BLS) is a good candidate for this task due to the intrinsic shape of the transiting light curve. Further improvement is obtained by parallelization of the BLS according to the number of bins. Both the sequential and parallel algorithms were applied to six chosen Kepler planetary systems (Kepler-7, Kepler-418, Kepler-439, Kepler-511, Kepler-807, Kepler-943) and to different light curve lengths. In all cases, speedup increased from 3 to 45 times as the number of bins increased, because the performance of the sequential version degrades with an increase in the number of bins, while remaining mainly constant for the parallel version. For smaller planets with longer orbital periods, a large number of bins is necessary to obtain the correct period detection.

As distinções teóricas entre a judicialização da política e o ativismo judicial

Este artigo analisa, de forma concisa, o nascimento e a evolução da teoria da separação dos poderes e de sua aplicação na Constituição Federal de hoje. Além disso, desenrola os diversos conceitos de Judicialização da Política e de Ativismo Judicial que existem perante os doutrinadores, demonstrando suas semelhanças e diferenças. Com isso, passa a investigar a atividade das cortes constitucionais, em especial do Supremo Tribunal Federal de nosso país, e do impacto da formação constitucional e do instituto da Judicialização da Política e do Ativismo Judicial. O objetivo deste trabalho é justamente compreender até onde se estende a possibilidade de interpretação legal e onde se inicia a atuação judicial de forma demasiada política. Para tanto, faz-se uma rápida digressão pelos institutos clássicos que deram origem a tal teoria, perpassando brevemente pontos importantes no constitucional, para enfim alcançar uma análise prática de um julgado atual.

Presença do sagrado na música caipira de raiz brasileira: análise de composições de Tião Carreiro e Pardinho

This dissertation examines the Presence of the Sacred in Brazilian Country Roots Music mainly focused on songs of the duo Tião Carreiro and Pardinho. By this way, a historical study of hillbilly music, hillbilly traditions and hillbilly culture is done. Through the same historical perspective is carried out a research on the life and work of the duo Tiao Carreiro and Pardinho, and finally analyzes the presence of the sacred in its music and in other duo artists music. With this dissertation, we attempt to observe the religious expression found in Brazilian country roots music, but also other religious events found in the music of the highlighted duo. In regard to the presence of sacred in songs the difference from this duo to the others duo artists is the fact that its songs contain other manifestations of religiosity beyond Brazilian popular catholicism.

O discurso publicitário de empreendedorismo do caderno PME do jornal O Estado de São Paulo

The media are very interested in the issue of entrepreneurship because of the recent popularization of ideas and beliefs around the matter of creating and developing business. The caderno Pequenas e Medias Empresas do Jornal O Estado de São Paulo, a prominent Brazilian journalistic vehicle, has been developing an advertising discourse about entrepreneurship. Case studies of the aforementioned editorial are analyzed according to the concepts of discourse analysis by Dominique Maingueneau, and also based on the concepts referring to myth and fetish, by Mircea Eliade and Massimo Canevacci, respectively. In addition to the hybridization of the journalistic and advertising genres, discourse analyzes demonstrate the use of mythical representations and of the fetish for the development of a persuasive discourse, which in a sense supports the emerging ideology of entrepreneurship.

O convívio entre gerações deveria ser uma ação espontânea e simples, no entanto, tornou-se necessária a mediação de profissionais para organizar e incentivar essa prática. Esta monografia reunirá informações e dados para propor um questionamento de como a sociedade chegou ao ponto de isolar os mais velhos ao mesmo tempo que envelhece desenfreadamente. Dadas informações necessárias, o presente trabalho tem como objetivo propor um complexo intergeracional com foco nas gerações extremas (crianças de 3 a 6 anos e idosos com 60 anos ou mais) com o intuito de proporcionar um aprendizado extracurricular alternativo para as crianças e melhor qualidade de vida para o envelhecimento dos mais velhos.

Desafios para implementação de empreendimentos urbanos: o programa de mobilidade de São Paulo de 2012

The present study seeks to understand and present the main dimensions (factors) that together can influence the implementation of urban mobility projects, such as the bus corridors for the São Paulo Mobility Program (2012). It aims to relate some of the obstacles faced by municipal public administration during the process of implementing urban infrastructure projects, financed by other spheres of government, and how this set of relationships, often unbalanced, impact on the development of these enterprises that are sometimes in fragile and disjointed projects that do not address the complexities of the problems and of the urban territory itself. From the survey and analysis of primary elements of the object in question, a critique is made that addresses such mismatches from several angles, considering as main intervening factors in the process of design and implementation of works and projects, the dimensions related to the specific project, the transfer of resources, and the budget and price, revealing the difficulties of São Paulo municipal administration in proposing, managing, financing and implementing complex projects such as bus corridors.
