O tema tratado no presente artigo diz respeito ao dano estético proveniente de cirurgia plástica estética. O objetivo é demonstrar, de acordo com a legislação, doutrina e jurisprudência, o entendimento acerca da responsabilidade do médico frente ao dano causado nas cirurgia plástica. Se trata de mostrar a obrigação em reparar ao dano causado à integridade física do paciente, gerando um dano moral, mas também a obrigação de reparar o dano estético, examinando jurisprudências e doutrina específica sobre dano estético. Conclui-se que o médico tem a obrigação de aplicar todo seu conhecimento e utilizar as técnicas mais adequadas para os casos específicos. Por meio da responsabilidade civil do médico, a obrigação que se assume é de obrigação de resultado.

This project investigates some issues related to slavery in Brazil during the 19th century, just after the Civil Wat ended in the USA and many Confederates (most of them, protestants) decided to emigrate to Brazil and settle in the interior of the so-called Província de São Paulo, more specifically, in the city nowadays known as Santa Bárbara d’Oeste. The research made use of published bibliography on Religious Science, History, Philosophy, Sociology, Economics, Law and Anthropology, drawing, as a result, multidisciplinary thoughts to ponder on the relationship between blacks and whites in Brazil and in the USA during the second half of the 19th century. A distinct mentality was noted then - one that justified slavery based on the Bible, philosophy as well as on economic and social components. Such mentality, different from the current one, indicates how the past experiences should be explored in order to identify possibilities to presently promote a sense of citizenship.

El estudio de la historia del arte es un importante camino en las ciencias humanas. La investigación hermenéutica de las obras de arte nos posibilita una comprensión más amalgamada de la propia existencia humana. Uno de los historiadores del arte que ha venido a destacar en el cambio del siglo XIX al siglo XX fue el alemán Aby Warburg. Según el historiador, profundamente inspirado por la perspectiva nietzscheana, la obra de arte lleva imágenes fantasmas; Imágenes-sobrevivientes que insisten en asombrar. Dentro de esta nueva perspectiva, el trabajo objetivo demostrar, por medio de la iconología de Warburg y de la genealogía nietzscheana, como la obra de arte sobrevive en el transcurso del tiempo, por medio de sus fantasmas, y lo que ella puede decir sobre lo contemporáneo. La obra Creación de Adán, de Miguel Ángel, será la herida abierta en el tiempo, para que podamos comprender cómo detener el avance del nihilismo, después de la muerte de Dios. ¿Qué podría decirnos todavía esta obra de arte sobre la creación, en un mundo marcado por la muerte de todas las muertes? Por lo tanto, el arte surge como un camino alternativo a lo sagrado. La herida causada por la muerte de Dios es fuente de dolor para contemporáneo, pero también posibilidad de salvación. La "imagen que cura", podría ser el título de este trabajo. Usando el dolor como fuente de significación, en ausencia de un creador a priori, necesitamos asumir la postura artística. Tacitamente, el acto de crear es la real imagen y semejanza entre lo divino y el "más allá del hombre"; La conclusión y el antídoto contra el nihilismo.

O presente trabalho abordará o tema de alienação parental, que ocorrem no ambiente familiar, envolvendo a criança e o adolescente, os pais e até mesmo a figura de um terceiro responsável pela a criança. A caracterização da prática do ato decorre da introdução de ideias falsas na criança e do adolescente, gerando o afastamento, rejeição do outro genitor. A prática não ocorre somente em relação ao pai ou à mãe, podendo também ocorrer por iniciativa de outros responsáveis. As soluções dos casos de alienação parental devem ser buscadas de maneira cautelosa, pois o processo de tratamento não envolve uma tarefa simples, isto é, as consequências dos atos praticados podem causar reflexos na vida de todos os envolvidos, principalmente na vida da criança e do adolescente, são os que se encontram em fase de desenvolvimento. Ainda, sobre a importância do tema, vale ressaltar do advendo da Lei nº 12.318/2010, com foco a proteção e garantia dos direitos fundamentais que devem ser garantidos pelo Estado, pela sociedade e pela família. A lei em seus artigos a definição de alienação parental, trata dos direitos fundamentais violados, quando há indícios leves da prática do ato, e ainda, trata da realização e necessidade da perícia psicológica e biopsicossocial além de medidas judiciais que podem ser aplicadas nesses prevendo a alteração ou atribuição da guarda do filho, mudança de domicílio.

This work, developed in conjunction with K3R, a Brazilian technology services provider, whose main product is the management of systems implementation, addresses the development and implementation of an information integration system through technological solutions whose automation it seeks to align to the current process flows in project management, in order to allow the optimization of the allocation of resources and get of results of each project served. It is the search for the solution of the problem in the absence of an integrated system, whose reflexes will allow the exploration of service opportunities that the current modus operandi of the company does not allow. The diagnosis included the mapping of K3R's project management processes and the search for a ready solution that could meet its needs. As a result of this, the K3R hasn't been find a information integrated system developed to manager projects, aligned the needs the demands of the company, the solution proposed involved the development of the custom solution, that extend for a innovation solution, inside market, which will provide the K3R in the medium term with the information that involves the process of allocating professionals, and the agility, integration and, as a consequence, reducing costs. The complexity in the development of this integrated solution is directly linked to several relevant variables. It begins with the understanding of the information contained in electronic spreadsheets, which require a field-by-field critical analysis, thus associating this information with the respective activities and their due to the relationship between the data source and the respective information destination, the process also includes what information will be entered manually or automatically and mainly to build a dynamic workflow, which needs to be intended for the use of the professionals involved. Based on an empirical evaluation, there are other business segments that perform the same activity in a similar way to K3R, so the solution designed for deployment allows to be replicated to other segments, that is, information commonly used in K3R to perform the allocation activity of outsourced professionals for a fixed period of time, may use this solution. With the presentation of this integrated information solution for the allocation of professionals to other segments, it was observed that there is a potential of commercialization of the same as a product or service, being necessary to evaluate there is need of some customization and revision of processes, as realized in the K3R.

A problemática do insider trading é um tema que avança proporcionalmente ao crescimento do número de investidores em ambiente de bolsa de valores, no Brasil. A velocidade com que as relações acontecem tem dificultado ainda mais a fiscalização do regulador das pessoas que, de má-fé tentam obter vantagem em detrimento dos pequenos investidores. Estes, grupo que deve ser protegido por estar em desvantagem volumétrica e informacional, fazem parte da essência de vedação ao uso de informações relevantes das empresas por parte de seus administradores. A lenta consolidação da regulação neste mercado associada à crescente evolução dos tipos de negócios que passaram a ser feitos para que se movimentasse valores em busca de aumento de capital formou cenário perfeito para que as práticas não-equitativas de mercado tivessem espaço e se consolidassem, fazendo com que o mercado de valores mobiliários fosse ambiente apenas para investidores com grande quantia e para movimentação de grande quantidade de valores mobiliários. A criação da Comissão de Valores Mobiliários – CVM, pode se dizer, foi o primeiro passo em busca do combate real e efetivo àqueles que se utilizavam de um ambiente ainda pouco regulado para obter dinheiro rápido e fácil. Desde então, se comparado ao volume de negociação, poucos foram os casos que repercutiram no mercado e que geraram qualquer discussão. O combate ao insider trading ganhou forma e robustez e passou a ser procedimental para qualquer instituição financeira, principalmente, para as que têm seu capital aberto em bolsa. Contudo, ainda que tenham diminuído ou quase não chamado muito a atenção, alguns exemplos são importantes cases no mercado para que possamos aprender a prevenir, identificar, tratar, investigar e sancionar, além de nos permitir criar mecanismos de mitigação destes riscos do lado do investidor. Para tanto, o presente trabalho delimitar-se-á na conceituação dos principais aspectos da infração em seu ambiente administrativo e analisará as medidas tomadas pelo regulador após o acontecimento de um ilícito, ainda que com tanta prevenção. 6 Dessa maneira, o que irá ser analisado é um case específico envolvendo um dos maiores grupos econômicos do país, no qual seus administradores e controladores utilizaramse de mecanismos para tentar obter vantagem econômica ilícita a partir da iminência de um fato que geraria grande prejuízo. Como será abordado neste trabalho, o insider trading não é só aquele que aufere lucro, mas também aquele que deixa de perder e, este segundo, é o que se encaixa ao exemplo que usaremos neste estudo, buscando identificar as formas usadas para o cometimento do ilícito e qual o procedimento adotado para sua punição, ainda que sendo previsto em norma a possibilidade de acordos. Ademais, ainda que sejam previstos mecanismos de prevenção muito avançados, unindo figuras de regulação e autorregulação na fiscalização e estudo dos mercados a fim de mitigar qualquer possibilidade de infração, aqueles que têm a intenção real de ludibriar o sistema e obter vantagem, têm conseguido obter êxito em alguns casos, mesmo que momentaneamente. O que se estabeleceu neste projeto foi a conceituação das diversas faces do tema, de seus agentes, players, tais como quais são os requisitos para caracterização de um insider trading, qual a definição destes requisitos, a identificação objetiva daqueles que podem figurar como agentes da infração, em que ambiente, utilizando-se de que ferramentas entre outros conceitos inerentes à figura do tipo. E detalhamento dos procedimentos adotados na fiscalização, investigação e punição daqueles que são identificados, buscando reunir as definições trazidas pelo regulador do mercado de valores mobiliários – CVM – em suas Instruções e deliberações, tais como a Instrução 358/2002, que trata da utilização de informações relevantes de uma companhia e as disposições previstas em lei, como a Lei das S.A. e a Lei do Mercado de Capitais, as quais andam juntas às instruções no âmbito administrativo, que é foco deste trabalho. Por fim, analisaremos o passo-a-passo do procedimento para sanção dos culpados e quais são os efeitos que uma condenação pode causar aos insiders e à companhia que teve seus valores mobiliários negociados de forma ilícita.

Common spaces comprise areas of private usage which allows in its schedule spaces that intermarry to public usage. The aim of this work is to reflect upon the relations between public spaces and private spaces; to introduce the discussion over the role and the values of these spaces in present cities and how the Architect interferes in the city s schedule. Proposal of projects that contain common spaces are analysed, covering the following characteristics: urban requalification and the reestablishment of the fresh air sociability in a city needy of spaces; the integration between the State (public) and Empresarial strategies (private) with participative urban policies; the public possibility of the private project to establish itself in the urban level and to manifest itself on the city image trough the spaces of public sociability; the Symbolism and the dialog representation between the social fields, productive and ambient; common space of exchange, circulation and a net of connections between the blocks; the possibility of bigger retreats, shading, adequate flow and the reestablishment of the fresh air sociability in a city needy of spaces. Case studies, that covers three projects in São Paulo city, are accomplished, as follows: Cetenco Plaza, project of architects Rubens Carneiro Vianna and Ricardo Sievers; Itau Empresarial Center (CEIC), project of architects Jaime Cupertino and Francisco Javier; and Brascan Century Plaza, project of architects Jorge Konigsberger and Gianfranco Vannucchi.

This study has as its theme the build of the hero and the villain in a political discourse, most especially in the discourse of Fernando Collor de Mello, based mainly on the semiotic theory of French line and the methodology developed by Algirdas J. Greimas and in Brazil by Diana Luz Pessoa de Barros and José Luiz Fiorin. The purposes are to examine the narrative and discursive strategies applied as persuasion mechanisms in a political discourse; among these strategies, show the resources used in the creation of the figure of the hero; check the intertextual and interdiscursive relations present in the text, which builds the ideological and socio-historical context of the discourses; to examine the role of the setting of the hero in a political discourse; and checking how Collor set up himself as a hero and how the media supported to create the hero picture taken by the political, until to the achievement of the presidency of the country, and the villain picture when he begun to be investigated by the crimes of corruption. The material analyzed consists of Fernando Collor discourse as president in 1990 and as a senator in 2007, beside of this and two magazine where the politician was masthead, and some records of the main printed communication press of the time. With the linguisticdiscursive analysis, it was possible to draw the line of the hero powerful as opposed to the hero suffered , used as persuasion techniques in political discourse.

This work investigates five sets of Social Interest Housing (HIS) inserted into ZEIS-3 (Special Zones of Social Interest), recently produced in São Paulo with the creation of the City Statute in 2001 and the creation of the city ZEIS. The housing sets were ―Conjunto Habitacional Parque do Gato‖ (build in 2004), ―Empreendimento 25 de Janeiro‖ (2007), ―Residencial Alexandre Mackenzie‖ (2009), ―Residencial Diogo Pires‖ (2011) and ―Conjunto Ponte dos Remédios‖ (2011). The research seeks to produce knowledge to make a primary data collection (primary sources and fieldwork) and secondary (bibliographic and conceptual reference) in the area and sets to be studied. The goal is to collaborate in the investigation of the recent production of HIS in consolidated areas of the city of São Paulo and in the proposition of HIS ventures and its share in building this city, from the point of view of urban social integration.

This study concerns about the analysis of the tales The young king, by Oscar Wilde, and The beauty and the beast or the too big wound, by Clarice Lispector, through the treatment that considers such texts as dialogues with folk tales. It enphasizes the tradicional fairy tale The beauty and the beast, that is considered as a starting point and arrival in relation to the mentioned structures and contents of the texts, according to the analogies that can be estabilished amongst them. With focus on the existencialist subject related to the questions of appearance and essence, its possible to arrive to a reflexion about the language of the art which has a dialogue with the culture. The texts are read stablishing a linking between the myths Narciso and Adonis which shows an intersemiotic relashionship with pictures that reveal the myths.The characters of the tales get a new meaning when they are looked at the pictures of Vênus and Adônis by Peter Paul Rubens, and Narciso by Caravaggio. To grasp the deep structures of the texts, verbal or noverbal, and to exam the intertextuality of the mecanisms, it was used theories related to filosophy of the language, to aesthetics concepcions that guide the reading of folktales and the mythical elements.

Biodiesel supply chain experiences a consistent trend of increase in production volumes and financial turnover since its foundation in 2005. This industry is placed at the intersection of three highly relevant national subjects: rural development, environmental sustainability and energy sustainability. Rigid framework was established throughout the supply chain due to its importance for the country. This framework has the potential to impact the performance of biodiesel production companies when neglected by them. Two types of regulation are especially important on this purpose: the auctions for biodiesel commercialization and the Social Fuel Stamp. The former is relevant for the actions of the organizations downstream of the supply chain, i.e., for the relations between the biodiesel producer companies and their clients. The latter is key for the actions of the organizations upstream the supply chain, i.e., for the relations between the biodiesel producer companies and their raw material suppliers. The most traditional concepts of business strategy are not able to provide the required theoretical tools to explain the obtainment of competitive advantage and, therefore, superior performance, since the relation between the company and the actors at the layer beyond the competitive environment. The concepts of nonmarket and nonmarket strategy present the theoretical tool to this kind of discussion. These concepts are especially valid for markets with monopolistic features or that are highly regulated. In this regard, it was established the following research question: How does nonmarket environment impact strategy and performance of the biodiesel producer firm? At the heart of this question lie two phenomena: the impact on the performance of the biodiesel producer company caused by the biodiesel auctions; and the impact on performance of the biodiesel producer company caused by the Social Fuel Stamp. From a methodological standpoint, it was adopted a phenomenological perspective for the conduction of this study, i.e., it was prioritized the understanding of the standpoints of the agents involved with the research question aiming to describe the observed phenomena and to discuss their causes. Three research strategies were adopted to drive the tasks of collecting and analyzing data: bibliographic research; bibliometric research; and grounded theory. The first two strategies aimed to delimit the state of the art about the concepts of nonmarket strategy; nonmarket environment; and studies on management in the context of the biodiesel supply chain. They were managed from the assessment of secondary data. The third strategy aimed to deeply explore the view of the agents with experience in the biodiesel industry with an eye on the relations between nonmarket environment and performance of the company. The discussions originated from data assessment were divided into two blocks: exploratory approach and theoretical approach. The former, with a descriptive purpose, exposed details on the functioning of the biodiesel auctions and of the Social Fuel Stamp, adding the first impressions on how these two issues of the nonmarket environment impact the performance of the biodiesel producer company. The latter, with a theoretical purpose, exposed details on the analytical and refining processes of the qualitative data that came from the field. It was discussed since the simplest assessments related to the frequency of words until the most sophisticated analysis of open, axial and selective coding. As core result, it is being proposed the following grounded theory: Market and nonmarket strategies are indivisible and key in the pursuit of superior performance in the Brazilian biodiesel market.

This research deals with aspects of the Contemporary Art Halls from three cities as know as ABC (Santo André, São Bernardo do Campo and São Caetano do Sul) in São Paulo, and emergencies in the management of events, their need for permanence, and the discussion of the collections resulting in the Acquisition Awards. Besides the related questions about the Salons, this PhD thesis relates to a proposal for renewal of the event as a regional culture promoter, also appraise the perspective of national importance colaborating with Brazil culture. In discussing the Contemporary Art Salons event from ABC in São Paulo, there is also the curator function as a new figure of importance in the event of relationship with the people and history. About the curator profession, this thesis defends the permanency of this relation between the knowledge production for future generations and the transmission of methods to build a network with this Salons and their collections. Add to this thesis, there is a social media discussion about their function in the contente prodution and propagation to the Salons actions, as well as profusion of culture and visual arts.

O seguinte trabalho de conclusão de curso tem como objetivo desenvolver um plano de assessoria de imprensa para a Associação Brasileira de Gestão do Esporte (ABRAGESP). A linha de pesquisa seguiu a análise do cenário esportivo brasileiro e como a entidade se encaixa nele, o diagnóstico e as propostas de ações para o público ligado à associação. As atividades propostas permeiam entre as inovações dentro das redes sociais, o contato próximo entre os associados da entidade e o posicionamento da mesma perante assuntos esportivos decorrentes da sociedade. O tempo vigente para realização do planejamento é de pelo menos dois anos e durante esse período, o objetivo é dar apoio à associação em todos aspectos comunicacionais.

Esta monografia se trata de um estudo crítico da cobertura jornalística realizada pelo jornal americano The New York Times acerca dos atentados terroristas de 11 de setembro de 2001, com o objetivo de identificar e compreender de que maneira esta contribuiu para a perpetuação e o agravamento da islamofobia nos Estados Unidos e no mundo. Para a produção deste trabalho, foi realizado um levantamento bibliográfico acerca das origens da religião muçulmana e sua trajetória ao longo da história; dos atentados de 11 de setembro de 2001 e suas consequências; da relação de tais eventos com o aumento da islamofobia nos Estados Unidos; da história e principais valores do The New York Times, bem como de sua relevância para o jornalismo internacional. A metodologia de pesquisa adotada foi a Análise de Discurso, tendo como base teórica as obras de Helena Brandão, Maria do Rosário Gregolin e Eni Puccinelli Orlandi. Este trabalho se pauta a partir das ideias de Edward Said acerca do tratamento ocidental dado às culturas chamadas orientais. Nas matérias de cobertura dos atentados analisadas, foram encontradas evidências de generalizações, maniqueísmo e preconceito.
